Instead, the UK aims to observe the progress of AI technology and develop regulatory frameworks if needed in the future. The UK government is working directly with AI companies to ensure safety and foster innovation.

While the UK takes a lighter touch with AI companies domestically, it has also taken the lead in global AI regulation efforts. In November 2023, the UK led 28 governments, including the US, China, and the EU, in publishing the Bletchley Declaration on AI safety. This declaration signifies an agreement among signatories on the risks and opportunities of AI and a commitment to collaborate on AI safety research. However, it does not establish specific international agreements on regulation.

Furthermore, the UK has announced the establishment of an AI Safety Institute, which will test new AI models developed by startups before their public launch. The UK aims to become a leading hub for AI development for startups globally. The AI Safety Institute has secured participation from renowned organizations such as Google DeepMind, OpenAI, the Alan Turing Institute, and the US-based Artificial Intelligence Safety Institute (USAISI). The institute is expected to launch in late 2024.

AI Legislation in the United States

Historically, the US federal government has taken a relatively light touch approach to regulating AI. However, in an effort to maintain America’s leadership in setting AI standards, President Biden issued the Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence. This order directs multiple federal agencies to adhere to eight priorities for AI safety, which encompass various areas ranging from civil rights to national defense. Instead of creating a new federal agency dedicated to AI regulation, the order mandates that relevant agencies address AI risks within their respective areas of expertise.

To further enhance AI safety, the US announced the creation of the US Artificial Intelligence Safety Institute (USAISI) on November 1, 2023. The USAISI will be responsible for developing standards related to the safety, security, and testing of AI models. It will also establish standards for authenticating AI-generated content, which has become increasingly challenging to verify as AI models advance.

Moreover, several US states have implemented their own AI legislation in response to pressing concerns that were not previously addressed by the federal government. For instance, New York passed the AI Bias Law in 2022, which prohibits employers from using AI tools to screen potential candidates unless they can demonstrate that biasing factors are not used in their models. Additionally, North Dakota passed House Bill No. 1361 in 2023, clarifying that personhood does not include environmental elements, artificial intelligence, animals, inanimate objects, corporations, or governmental entities.

AI Legislation in China

China has taken a unique approach to AI legislation by introducing regulations earlier and more swiftly in response to specific AI developments. The country released its first official regulatory regime, the Generation AI Development Plan, in 2017. Since then, additional laws have been introduced to regulate AI. In 2022, China banned AI-generated media that does not contain watermarks, and more recently, it banned ChatGPT and any proxy servers hosting its services.

On August 15, 2023, the Cyberspace Administration of China (CAC) released the Generative AI Measures, the first regulations specifically targeting generative AI. These measures include requirements for labeling generative AI content and mandate security assessments and algorithm registration for generative AI services that have the potential to sway public opinion or advocate subversive activities.

However, the final version of China’s Generative AI Measures ended up being less restrictive than initially proposed in early 2023. This change may be attributed to concerns expressed by Chinese businesses and entrepreneurs that overly burdensome regulation could stifle the nascent AI industry, especially as other world economies accelerate their AI technology.

Towards a Better AI Policy Framework

The various models of AI regulation implemented by different countries represent a spectrum of responses to this emerging technology. China’s Generative AI Measures exemplify a top-down approach, with the CAC having the ultimate authority to determine acceptable AI-generated content. The EU’s AI Act takes a cautious approach, emphasizing collaboration between startups and government regulators, particularly for startups working with advanced AI models. The US and UK have adopted a more laissez-faire approach, although they have recently unveiled strategic policies aimed at setting standards rather than enacting legal regulations.

It is crucial for governments to consider the needs of AI startups operating in this environment. Valuable lessons can be learned from previous policy regimes, such as the UK’s fintech regulatory sandbox. This sandbox provided a regulated testing environment for startups to try out their financial products on a limited scale before a full-scale launch. By balancing public interest with innovation, governments can set clear standards that allow startups to participate without excessive burden. Cumbersome compliance requirements can hinder the progress of innovative startups while benefiting larger firms with greater resources. Jurisdictions that establish transparent guidelines for compliance will foster stronger levels of trust and confidence in startups when scaling their operations and expanding into new markets.
